These General Conditions of Sale exclusively govern commercial relations with our customers for the sales and services presented on the site www.socharm.fr and, more generally, are applicable to all commercial documents issued by our company.
Any order implies prior consultation and acceptance of these General Conditions of Sale.
It is understood that persons considered legally incapable of contracting, in particular non-emancipated minor children, must obtain the authorization of their legal representative prior to any order.
Given the seasonal nature of our business, our product offers are valid within the limits of available stocks.
Article 2: Order
You can place an order on our site by selecting the items of your choice, which you will then place in your basket by clicking on the "Add to basket" button.
You can access the summary content of your basket at any time as long as the order is not definitively validated in order to correct any errors in data entry.
It is only after confirmation of the accuracy of the information provided that the order is registered. This order acceptance becomes final by clicking on the "Order and pay" button.
We will acknowledge receipt of your order as soon as possible in the form of an e-mail summarizing your purchases which will be sent to you at the e-mail address provided by you during the order confirmation.
When entering your order, you are also informed of the availability of the items. Only available products can be ordered.
In the event that, beyond our control, a chosen item is unavailable, you will be notified as soon as possible. You can then modify your choice if you wish. You can also cancel your order at any time before receiving your package, regardless of the delivery time.
socharm.fr reserves the right not to honor an order in the event of a legitimate reason as defined by the regulations (dispute relating to a previous order, abnormal request from the customer).
Article 3: Engravings and Special Creations
For any request for special creation or photo engraving, you agree to only offer drawings or photographs that do not constitute an infringement of the intellectual property rights of third parties or an attack on persons and respect for privacy or an attack to public order and good morals nor more generally an infringement of the applicable regulations in force.
SPECIFICITIES OF SPECIAL CREATIONS:
Unless we are mistaken, we cannot take back items engraved or personalized at your request, such as special creations. The right of withdrawal and the "Satisfied or refunded" guarantee do not apply to items engraved or personalized at your request. Consequently, these products are neither exchangeable nor refundable.
Article 4: Price
The prices are indicated in Euros all taxes included (TTC), excluding shipping costs, the amounts of which are defined in the delivery article.
In the case of a shipment outside the European Union, taxes may be invoiced upon receipt of your package. These taxes, which depend on the country, remain your responsibility. We cannot inform you of their exact amount.
The VAT included is the French VAT in force on the day of the order.
The products remain the property of SoCharm.fr until full payment of the price.
Article 5: Payment
Payment is made online, at the time of the order, by credit card, with PayPal, by check, bank transfer, gift cards, gift certificates.
VISA and EUROCARD MASTERCARD bank cards (except E-cartes bleues) whose account is domiciled in metropolitan France (including Corsica) and in the overseas departments are accepted.
When you pay by credit card, the debit is made at the time of validation and preparation of the available items.
When paying by credit card, do not forget to indicate the last 3 digits (visual cryptogram) appearing on the back of your card.
Transactions made by credit card on SoCharm.fr are secured by the CIC payment system. All the information exchanged to process the payment (16-digit card number, expiry date, visual cryptogram) is encrypted using the SSL protocol. This data cannot be detected, intercepted or used by third parties. They are also not stored on our computer systems.
Purchases paid by credit card (VISA and MASTERCARD) can be secured by the 3D Secure control system. When you pay for your order by credit card, if your bank adheres to the "Verified by Visa" or "Secure Code Mastercard" payment security program, after clicking on "Order and pay", you may see a new screen appear, you inviting you to identify yourself, for example, with a code received by text message.
For payments by gift cards and gift certificates, if the amount credited to the gift card is not sufficient to pay for the entire order, you can pay the balance online by credit card or with Paypal. It is possible to combine several gift certificates for the same purchase. Gift cards and gift certificates cannot be exchanged or refunded in whole or in part, in particular on expiry of their validity date or in the event of loss or theft, or resold for their value.

Article 6: Delivery
Delays 2 to 3 days.
The different delivery methods, which you will find the summary below, are offered to you in your basket when you order.
deliveries are made in approximately 2 days* from your order placed before noon and according to the conditions specified on this site when you add an item to your basket.
For any other order (mail, fax, telephone), delivery in 2 days* runs from the time your parcel is taken over by the carrier. Your package will therefore reach you within 5 days* (average time observed for available items) within a time limit of 15 days.
*Working days, excluding public holidays, average time observed for delivery of non-personalized items available in mainland France (including Corsica). Additional 7 days for engraving, ordering specific custom designs. For an unavailable item, count an average delay of 3 to 4 weeks, within a time limit of 2 months (excluding sold out items).

Your item must be returned to us for an exchange or refund, at no additional cost, within 14 days from the date on which you informed us of your decision to withdraw.

Only items returned in new condition and without having undergone transformation in a condition allowing their resale will be exchanged or refunded. Items returned incomplete (user manual, box, warranty certificate), damaged or damaged will not be taken back.

In the event of withdrawal within the framework of the legal deadline or the "Satisfied or refunded" commercial guarantee, we will reimburse you:

- €8.95 for any other delivery (DROM-COM, EU and outside the EU, Postal Sectors) excluding national taxes for delivery outside the European Union which remain the responsibility of the customer.
In all cases, the fixed contribution to the cost of processing the order is not refunded in the event of partial return following an order of several items or non-return of the gift associated with an obligation to purchase.
The costs of returning the item are not refunded, except in the event of a proposal by SoCharm.fr of an item to replace the item ordered which would be unavailable or in the event of delivery of a defective or non-compliant item. the item ordered.
Article 8: Guarantee socharm.fr
The warranty period for all our collections is two years provided that the product concerned has been worn or used under normal conditions of use, but does not cover damage caused to the products by accident, misuse or abuse, modification , attempted repair, negligence after purchase, ordinary wear and tear. The plating of our collections is guaranteed for six months, provided that the advice on care for the product has been followed.

Article 9: Advice for use, care and maintenance
All jewels are made with care and with the best materials but remain very delicate. Special care is required. Please observe the following care instructions:
- Keep your jewelry in the original packaging or in a soft pouch to avoid scratches.
- Avoid contact with water Remove jewelry before washing hands, swimming and/or applying products (e.g. perfume, hair spray, soap or lotion) which may damage metals and reduce life of the metallic coating, lead to discoloration and loss of brilliance of the crystal.
- Avoid contact with hard objects (e.g. knocking against objects) which can scratch the metal or chip the crystal.
- Frequently polish your jewel with a lint-free cloth in order to preserve its original shiny appearance.
Article 10: Legal guarantees
Independently of the contractual guarantees above, the seller is liable for any lack of conformity of the goods sold in accordance with articles L. 217-4 and following of the Consumer Code:
- You thus benefit from a period of two years from the delivery of the goods to act;
- You can choose between repairing or replacing the goods, subject to the cost conditions provided for in article L. 217-9 of the Consumer Code;
- You are exempted from providing proof of the existence of the lack of conformity of the good during the two years following the delivery of the good.
The seller is also liable for hidden defects of the goods sold under the conditions provided for in articles 1641 and following of the Civil Code, legal guarantee against hidden defects for which you have direct recourse against the seller.
You can choose between canceling the sale or reducing the sale price in accordance with article 1644 of the Civil Code.

Article 11: After-Sales Service
At socharm.fr, qualified professionals are at your disposal to carry out an overhaul or repair.
The technicians of our After-Sales Service can also intervene after the end of the socharm.fr commercial guarantee. Return your item to us with its certificate or invoice, specifying the nature of the repair. . For safety, send your items for repair only by post. The costs of sending the article are your responsibility. See “ Article 12: Return of Items ”
A free estimate can be sent to you upon receipt by us of your article. You will then have a period of one month from its date of issue to return it to us with your agreement. A 20% deposit may be required. The work will be carried out after receipt of the estimate accepted within the time specified on the estimate, and your article will be returned to your address, at our expense, if the intervention is not feasible or in the event of refusal of your choice.
In the event of repairs carried out out of warranty, the costs of returning the item will be at your expense. Our interventions are guaranteed for one year (parts and labour) within the limits of normal use. We also take care of the repairs of brand watches for which we are approved.
In accordance with the law, you have a period of 14 days from the date of signature of the After-Sales Service quote to withdraw. For this purpose, you can use the SAV withdrawal form or any other unambiguous declaration.
In the event of withdrawal within this period, we will reimburse you for any 20% deposit, no later than 14 days after receipt of your decision to withdraw, using the same method of payment as that used for payment, except with the agreement of the customer. The cost of returning the item will be at our expense.
In the event of execution, at your request, of a repair before the end of the legal withdrawal period, you will have to pay the amount corresponding to the service provided until the communication of your decision to withdraw. This amount is proportionate to the total price of the service agreed in the estimate.

Article 12: Return of items

Section 13: Environment
The preservation of the environment is a permanent concern of socharm.fr.
In accordance with Decree No. 2005-829 of 20/07/2005 relating to the disposal of waste electrical and electronic equipment ("WEEE"), socharm.fr undertakes to contribute to the treatment, recovery and recycling of electronic components contained in our quartz watches put on the market after 08/13/2005.
This means that under no circumstances should you dispose of the used product in nature, in household waste bins or with other unsorted municipal waste, so that it can be subject to selective collection with a view to recovery, reuse or recycling.
Selective collection points are made available to you by the municipalities for the processing of waste electrical and electronic equipment.
Used batteries must be removed before disposing of the product at the end of its life or if it is no longer used. The sorting rules must also be respected for packaging waste.
Considering the potential effects of this waste, you will thus act in favor of the environment, by contributing to the preservation of natural resources and the protection of human health.
In application of the "anti-waste for a circular economy" law ("AGEC" law n°2020-105 of 02/10/2020), a new unique identifier per sector will be issued by the Ecological Transition Agency (" ADEME") from January 2022 to facilitate the monitoring and control of compliance with the obligations of Extended Producer Responsibility ("EPR").
